Whether or not you are a registered member, by using this service or website (use of the website or the singles matching service hereinafter collectively referred to as "Service"), you fully agree to all of the terms herein. IF YOU DO NOT AGREE TO THE TERMS, PLEASE DO NOT USE THE SERVICE AND DO NOT REGISTER AS A MEMBER. The terms are subject to change at the sole discretion of the Company, effective upon posting the changes on the website. Any use of the service after the changes have been posted will constitute acceptance of such changes.
1. Acceptance. By using the Service, you accept the terms contained herein.
2. Eligibility. You must be at least 18 years old to register with the Service. By registering with the Service, you represent and warrant that you are at least 18 years old. Any person other than yourself is prohibited from using your membership account.
3. Term. This Agreement is in effect at any time that you use the Service for any reason. Either you or the Company may terminate the Agreement at any time, for any reason, without explanation.
a. If you wish to terminate your account, you must send written or email notice of your termination to the Company. Upon termination, the Company is not obligated to refund any money, including any unused portion of a subscription fee.
b. The Company may, at its sole discretion, terminate your account. The Company is not required to provide you notice of, nor offer you a reason for, the termination. The terms of this agreement that may by their nature survive termination of this Agreement shall survive termination of this Agreement. Upon termination, even upon termination by the Company's discretion, the Company is not obligated to refund any money, including any unused portion of a subscription fee. The Company may, in its sole discretion, deny registration to any user.
4. Warranty Disclaimers. THE COMPANY PROVIDES THE SERVICE "AS IS." THE COMPANY GRANTS NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING ALL EXPRESS WARRANTIES, IMPLIED WARRANTIES OF MERCHANTABILITY, AND WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. The Company makes no warranties with respect to the availability and connectivity of the Service, nor does the Company warrant that the Service will be free of defects, or that any defects will be corrected. The Company also does not make any warranties regarding non-infringement.
5. User's Obligation of Regularity. You must and are required to log into your account at least once every 60 days. Failure to do so shall be considered a material breach, and the Company reserves the right to terminate your account and purge any data from the Service that relates to you.
6. Interactions with Other Users
a. You are responsible for your interactions with other users of the Service. You are responsible for taking precautions when interacting with other users.
b. You understand that it is possible that another user, or an unauthorized party, may post offensive content on the website. It is also possible that another user or unauthorized party may obtain personal information about you through your use of the Service, and may use that information to harass or injure you. The Company is not responsible for the use of any personal information that you disclose.
c. The Company does not warrant the accuracy, completeness, or usefulness of any information on or made available by the Service. The Company neither endorses nor accepts responsibility for the accuracy of any information of another user. THE COMPANY WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM THE RELIANCE ON ANY INFORMATION POSTED ON THIS SITE BY ANOTHER PARTY.
d. The Company makes no guarantees about your success in meeting others through the use of this Service.
e. You will not use the Service for any commercial endeavors.
f. You agree that your account with the Service is for your exclusive use. You are fully responsible for the results of any unauthorized access to your account. You are further responsible for maintaining the security of your account and the confidentiality of your username. If a third party uses your account, you agree to promptly notify the Company.
7. Content Posted
a. You agree that you are solely responsible for the content that you publish or display (hereinafter, "post") on the Service, or transmit to other users of the Service.
b. You will make all uses of the Service conform to any applicable laws and regulations. You will not use the Service to harass, promote racism or bigotry, advocate physical harm, or violate any laws or regulations.
c. You will not post any material that infringes on the copyright, trademark, trade secret, or any other rights of a third party without the prior written consent of the owner of such rights. Further, you warrant that you have the right to grant, and you automatically grant, the Company a perpetual, non-exclusive, fully-paid, worldwide license to use, copy, display, reproduce, adapt, modify, and to prepare any derivative works of any information posted on the Service. You waive any and all moral rights and any comparable rights to be identified as the author or owner of your own profile.
d. You will not post or transmit anything that is defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, displaying nudity, threatening, harassing, racially offensive, or illegal, or anything that infringes on the rights of another party, including intellectual property rights and rights of privacy and publicity. You will not harass or promote physical harm to another person. You will not use the Service for spamming or transmitting viruses. You will not transmit any junk emails or chain emails.
e. You will not provide information that is false or misleading, whether that information is transmitted to the Company or to another user. All information you provide, including all registration information, will be accurate, whole, and current. You shall not post a picture of another person on your profile. You warrant and represent that the information you post is of you, including photographs of your person and possessions, and that you have full title to the possessions.
f. You will not use the Service to engage in advertising to other users regarding the sale of any products or services.
g. You will not use any devices that contain any references, meta tags, or codes. You will not decipher, sublicense, compile, decompile, translate, modify, adapt, sell, or reverse engineer any portion of the Service, website, or software.
h. The Company may, at its sole discretion, but is under no obligation to, review, monitor, reject, and/or delete any posted content that in the Company's judgment violates or is alleged to violate the terms of this Agreement, or violate any national or international laws or regulations.
8. Limitation of Liability
a. In addition to all other limitations of the Company's liability found in these terms, the Company is further not liable for any damages whatsoever, whether they be consequential, direct, indirect, general, special, compensatory, or incidental damages, for any claim that in any way relates to the Service. This limitation includes, but is not limited to, liability relating to loss or corruption of data, interruptions in service or connectivity, dealings with third party advertisers on the Service, and the conduct of other members on the Service. The limitations include, but are not limited to, any damages from bodily injury and emotional distress. The limitations shall apply even if the Company has been advised of the possibility of damages.
b. The Company is not liable for the untrue, deceptive, misleading, or elusive information posted by its users.
c. The Company is not responsible for and cannot be liable for any damages that occur relating to the use of links on the Service to external websites. The company is not responsible for any loss or damages from your dealings with parties, advertisers, or others found on such external links.
d. You agree to indemnify and hold harmless the Company, its subsidiaries and affiliates, officers, agents, and other partners and employees, for any losses, costs, liabilities, attorney's fees, and expenses relating to your use of the Service, including any breach of the Agreement by you.
e. In no event whatsoever will the amount of the Company's liability exceed the price paid by you for your account.

9. Proprietary Rights. The Company owns and retains proprietary rights in the Service. The Service contains copyrighted material, trademarks, and other proprietary information of the Company and its licensors. Except for that information that is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
10. Privacy and Confidentiality.
a. Your use of the service is also governed by the Privacy Policy, posted on the Service website and incorporated herein.
b. You agree to review, read, and comply with the Privacy Policy. Communications between users that are not readily accessible to the public may be reviewed by the Company, but will be treated as private to the extent required by applicable laws.
c. You agree to receive emails notifying you of your matches. You also agree to receive emails notifying you of parties, events, and promotions that are organized by the Company or third parties. You also agree to receive emails notifying you of changes in the Service. If you do not agree, you are not authorized to use the Service.
11. Jurisdiction and Choice of Law. In any dispute arising out of the use of the Service, you agree that any such dispute shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions. You expressly agree to consent to the exclusive jurisdiction and venue of the state and federal courts of the State of Illinois, in Cook County, for the resolution of the dispute.
12. General Provisions. This Agreement contains the entire agreement between you and the Company regarding the use of this Service. If any one provision in this Agreement is held to be invalid, the remainder of this Agreement shall continue in full force and effect.
